Terms and conditions

These terms govern your use of this site and any order you place. Placing an order means you accept them. They do not affect your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002.

1. Who you are contracting with

2. How a contract is formed

Placing an order is an offer to buy. Our confirmation email acknowledges receipt; it does not by itself form a contract. The contract is formed when we dispatch the goods. If we cannot supply an item we will tell you and refund it in full.

3. Prices

Prices are in South African Rand and include VAT where VAT applies. The price shown is the price you pay for the goods; delivery is added at checkout and shown before you commit.

We correct pricing errors. If an item is listed at an obviously wrong price we will contact you before dispatch, and you may confirm at the correct price or cancel for a full refund.

4. Wholesale accounts

Approved wholesale customers see wholesale prices once signed in. There is no minimum order quantity and no minimum spend. Wholesale pricing is for resale or business use and is offered on the basis that you are buying as a business; we may ask for evidence. We may decline or withdraw a wholesale account, and we will say why.

5. Stock and authenticity

All goods are sourced through authorised channels and supplied in original manufacturer packaging. Testers are described as testers. Batch codes and packaging vary between production runs; a difference in packaging is not in itself a defect.

6. Payment

Payment is taken at checkout through our payment provider. We do not store card details. Goods remain our property until paid for in full.

7. Delivery

Delivery terms, charges and timescales are on our Delivery Information page and form part of these terms. Risk in the goods passes to you on delivery.

8. Cancellations and returns

Your cancellation and return rights are on our Returns and Cancellations page and form part of these terms.

9. Your account

Keep your password to yourself. Tell us at once if you think someone else has used your account; you are responsible for orders placed through it until you do.

10. Our liability

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms. We are not responsible for loss that was not foreseeable, nor for business losses where you buy as a business. Nothing here excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, including our obligations under the Consumer Protection Act.

11. Use of this site

You may use this site to browse and to buy. You may not scrape it, copy the catalogue, or use it to build a competing listing. Product images and descriptions are used under licence from our suppliers or are our own; brand names and marks belong to their owners.

12. Changes to these terms

We may change these terms. The version that applies to your order is the one published when you placed it.

13. Complaints

Write to info@thescents.co.za. We aim to acknowledge within two working days. If we cannot resolve it, you may refer the matter to the National Consumer Commission or a recognised consumer goods ombud.

14. Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
